6. Liability of the contracting parties

Escape Events GmbH's liability for defects in performance is limited to defects that are attributable to intent or gross negligence. The customer is not entitled to a reduction. The purchaser's right to rectify the defect remains unaffected.

Claims for damages and reimbursement of expenses on the part of the purchaser, regardless of the legal reason, in particular due to breach of obligations from the contractual relationship and tort, are excluded. This does not apply if liability is mandatory, e.g. according to the Product Liability Act, in cases of intent, gross negligence, due to injury to life, limb or health, due to the violation of essential contractual obligations.

The claim for damages due to essential contractual obligations is, however, limited to the contract-typical, foreseeable damage, unless there is willful intent or gross negligence or liability for injury to life, limb or health. This does not involve a change in the burden of proof to the detriment of the customer.

Personal items carried are at the risk of the customer in the play and recreation rooms. Escape Events GmbH assumes no liability for loss, destruction and damage, except in the event of gross negligence or intent on the part of Escape Events GmbH or its employees.

Escape Events GmbH is not liable for damage caused by force majeure, riot, war or natural events or other events for which it is not responsible (e.g. strike, lockout, traffic disruption, high-level orders in Germany or abroad) or not culpable caused technical faults (such as the EDP system).

Computer viruses or deliberate attacks on IT systems by "hackers" are also considered to be force majeure, provided that appropriate protective measures have been taken against them.

The customer is liable for all damage to buildings or inventory caused by him or third parties in his area.

7. Complaints:

In the event of complaints, employees of Escape Events GmbH must be contacted immediately. Every oral notification must be made in writing as soon as possible.

Complaints must be submitted within 14 days of visiting the attraction, stating the booking number.

8. Record:

Escape Events GmbH reserves the right to record individual calls and evaluate emails for training purposes and to improve the service standard. Furthermore, the game rooms are monitored for security purposes and for the purpose of coordinating the game. For advertising purposes, photos and video recordings are made for individual games. With a corresponding note on the waiver, the buyers agree to this.

9. Arrival, Parking:

The arrival is the sole responsibility of the customer.

Escape Events GmbH does not provide any parking spaces for its visitors.

10. Delays:

“EscapeGame Vienna” games are live events. Since the rooms are specially prepared for each booking and reserved for the booked period, the customer must appear on time for the booked period and factor in delays due to traffic, public transport and other factors.

If the show is not on time, the agreed service cannot be provided and admission to the attraction cannot be granted. The ticket expires and there is no entitlement to reimbursement of the agreed remuneration.

11. Final provisions:

If individual provisions do not become part of the contract in whole or in part or are ineffective, § 306 BGB applies.
